Terms of Service

Effective date: 5 March 2019
Last updated: 3 April 2026 Operator: [Operating entity legal name and registered address]

These Terms of Service ("Terms") govern your access to and use of the Klyroswap crypto-exchange service at [example.com] (the "Service"), operated by [Operating entity] (the "Operator," "we," "us"). By creating an order on the Service you agree to be bound by these Terms.

1. The Service

The Service offers manual, operator-mediated exchange between Euro (via SEPA) and a defined set of crypto-assets (BTC, ETH, LTC, USDT TRC-20, BNB BEP-20). Each exchange is a discrete, one-time transaction at a rate locked at the time of order creation. We do not custody customer crypto-assets, do not maintain customer balances, and do not offer trading accounts, order books, or any margin or derivative products.

2. Eligibility

You may use the Service only if you are at least eighteen (18) years of age and only from a jurisdiction in which use of the Service is lawful for you. You are solely responsible for confirming that your use of the Service complies with the laws of your country of residence. We may refuse, restrict, or terminate access from any jurisdiction at our sole discretion.

3. Order lifecycle

An order proceeds through the following states: Created → Awaiting payment → Payment received → Sending crypto → Completed. An order may be Cancelled by the Operator at any non-terminal state, with a refund per Section 6. An order that does not receive a matching SEPA transfer within sixty (60) minutes of creation will be marked Expired and no funds will move.

4. Locked rate

The exchange rate displayed at the time of order creation is locked for thirty (30) minutes. If the corresponding SEPA transfer is not received within that window, the Operator may, at its discretion, either re-quote a new rate or cancel the order with a full refund (no fee in this case).

5. Limits

Per-transaction limit: minimum €200, maximum €999. Per-customer limit: €999 per email address per rolling 24-hour window. The Operator may adjust these limits prospectively at any time. The version of these Terms displayed at the time of order creation governs that order.

6. Refunds and fees

Where an order is cancelled at any state in which Euro has been received from the customer, the Operator will refund the Euro amount to the original source IBAN, less a flat cost-recovery fee of €5, within five (5) working days.

Where an order is cancelled at the Operator's discretion because the order itself never received a matching payment, no fee applies (no funds have moved to refund).

7. Information accuracy and customer responsibilities

You are solely responsible for the accuracy of the information you provide, including without limitation the receiving crypto wallet address. The Operator performs visual verification of the wallet address before broadcasting any crypto-asset, but cannot reverse a transaction once broadcast on a public blockchain. We have no liability for losses arising from customer-provided information that is incorrect, malformed, or under the control of a third party at the time of broadcast.

8. No fiduciary or custodial relationship

We do not hold customer funds in custody outside of the brief operational window required to execute a specific order. No customer accounts, balances, or wallets are maintained on our infrastructure. Each order is settled and closed at the time of the relevant SEPA matching and crypto-asset broadcast.

9. AML and sanctions screening

Use of the Service is subject to our AML Policy, available at /aml on the Website. The Operator may, in its sole discretion, refuse, delay, or reverse any transaction in line with that policy.

10. No guarantee of availability

We may suspend the Service for maintenance, security, or compliance reasons without notice. We do not guarantee any minimum uptime or response time. The locked-rate window described in Section 4 is the only quantitative service- level commitment in these Terms.

11. Limitation of liability

To the maximum extent permitted by applicable law, the Operator's aggregate liability to any customer in connection with the Service is limited to the Euro amount of the order in respect of which the liability arose. In no event will the Operator be liable for indirect, consequential, special, incidental, or punitive damages.

12. Governing law

These Terms are governed by the laws of [Operating entity jurisdiction], and any dispute arising in connection with these Terms will be submitted to the exclusive jurisdiction of the competent courts of that jurisdiction.

13. Changes to these Terms

We may amend these Terms by publishing a revised version on the Website. The version in force at the time of order creation governs that order.

14. Contact

Questions about these Terms should be sent to legal@klyroswap.com or via the channels listed on the Contacts page.
